Duncan — Terms of Use

These Terms of Use ("Terms") are a contract between you and Macbeth Labs ("Macbeth Labs", "Duncan", "we", "us"), the maker of the Duncan app, governing your use of the app. By using Duncan, you agree to these Terms. If you do not agree, do not use the app.

1. Who can use Duncan

You must be at least 13 years old (or the minimum age required in your country) to use Duncan, and old enough to form a binding contract. If you use Duncan on behalf of others, you are responsible for your use of it.

2. What Duncan does

Duncan helps you capture thoughts by voice or text, sorts them into dated reminders and notes, and brings them back to you as gentle reminders ("nudges"). Features and availability may change over time.

3. Not medical or professional advice

Duncan is a productivity and reminder tool. It is not a medical device and does not provide medical, psychological, legal, or financial advice, and does not diagnose or treat any condition, including ADHD. Do not rely on Duncan for anything where a missed or late reminder could cause harm; always use your own judgment and appropriate professional care.

4. Your content

You keep ownership of the content you create in Duncan. You grant us a limited licence to store, process, and display that content solely to operate the app for you (including sending it to the processors described in our Privacy Policy). You are responsible for the content you capture and share.

5. Subscriptions, free trial, and billing

Some features ("Duncan Plus") require a paid subscription, offered on a monthly or yearly basis and sold through the Apple App Store.

6. Acceptable use

Don't misuse Duncan: no illegal use, no interfering with or attacking the service, no reverse-engineering except as permitted by law, no using it to violate others' rights. We may suspend or terminate access for violations.

7. Third-party services

Duncan relies on third-party providers (see the Privacy Policy). We are not responsible for those services' own acts, and their terms may also apply to your use of features that depend on them.

8. Disclaimers

Duncan is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that reminders and notifications will always be delivered on time (delivery depends on your device, network, and platform).

9. Limitation of liability

To the fullest extent permitted by law, Duncan will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or missed reminders. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD $50.

10. Changes and termination

We may update these Terms as the app evolves; material changes will be notified in the app. You may stop using Duncan at any time and delete your account in the app. We may suspend or end the service or your access, with notice where reasonable.

11. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules, and the courts of British Columbia will have jurisdiction, unless mandatory local law provides otherwise.
